Under Subsection 25 (1) of Immigration and Refugee Protection Act (IRPA), a foreign national may request for an exemption based on Humanitarian and Compassionate (H&C) Considerations, and apply for permanent residence from within in Canada.

A request based on H & C grounds is made if the foreign national has to face disproportionate hardships if they have to go back to live in their home country, and there are compelling reasons for granting an exemption and facilitating the processing of application for permanent residence from within Canada. The best interests of children are also considered in assessment of H & C Applications.

It should be noted that `H & C Consideration` is not another program or method to apply for permanent residence in Canada. It is like an exceptional measure to deal with extraordinary situations when there are no explicit/implicit provisions provided in the legislation or  Canadian immigration system for responding to any particular, exceptional circumstances.
